What happens if I don’t agree with how the commission votes?

As a party in Interest with standing, appeals from the decision under the WPA must be made within 10 business days of the decision by the Commission, i.e. the vote of the Commission, and are filed with the State Department of Environmental Protection in Worcester. Standing to take an appeal varies from an appeal to the Superior court, which is outlined in 310 CMR 10.05 (7) which also outlines the process to follow. Appeals from the local by-law are made to the district court in East Brookfield.

It is also important to note that whomever has the legal right to file an appeal or has “standing” will vary, depending on whether the permit was denied or approved by the Commission.
